These Terms and Conditions apply to all services provided by Collateral Trading 456 cc, trading as iWater Management.

Borehole Drilling

  1. The Contractor – Collateral Trading 456 cc trading as iWater Management, hereinafter referred to as the “Contractor”.
  2. The Customer – The customer and/or the property owner is the liable party to settle all invoices of the Contractor in full.
  3. Any change, amendment, or variation to the terms of this contract must be in writing and signed by both parties.
  4. Payment – EFT: A 70% deposit is required for booking, and the remaining 30% is payable within 7 days of work completion. Projects under R30,000 require full upfront payment.
  5. The Contractor does not guarantee interception, quantity, quality, or clarity of water, regardless of how or by whom the drilling position is determined.
  6. If water is not intercepted (dry hole) or yield is insufficient, the Customer is still liable for the depth drilled, casing used, and yield test costs. The quoted per-meter price remains applicable. Acceptance of the quote confirms this.
  7. It is the Customer’s responsibility to obtain permission to drill. Acceptance of the quote indicates such permission has been obtained.
  8. If the Customer refuses the Contractor access or prevents drilling, the Contractor may claim 70% of the contract price as pre-estimated damages, payable within 48 hours.
  9. The removal of drilling mud, chips, and dust is the Customer’s responsibility.
  10. The Contractor is not liable for damage to movable/immovable property or for direct/consequential loss caused by drilling or equipment movement.
  11. The Contractor is not liable for injury or loss of life, animals, or goods due to the drilling process or equipment movement.
  12. Serviceability – If after completion, the borehole allows for free rotation and movement, it will be accepted as serviceable.
  13. If dolomite cavities cannot be cased and drilling stops due to air loss, the Customer remains responsible for full drilling and casing payment.
  14. The Contractor is not liable for collapse or damage to boreholes caused by subterranean movements, tremors, or earthquakes.
  15. The borehole and equipment remain the property of iWater Management until fully paid. Risk transfers to the Customer on delivery.
  16. Both parties consent to Magisterial Jurisdiction. The Customer is liable for all recovery costs.
  17. The Customer consents to iWater Management using any project-related graphics, logos, photos, or videos for marketing and advertising purposes, in compliance with the POPI Act.

Note: This contract and all quotations/invoices are deemed fully accepted with payment of any deposit.

Water Treatment Plans and Solar Powered Systems

  1. The Contractor – Collateral Trading 456 cc trading as iWater Management.
  2. The Customer – Agrees to settle all invoices in full, on time.
  3. Changes to contract terms must be in writing and signed by both parties.
  4. Payment: 70% deposit to book, 30% balance due within 7 days of completion. Projects under R30,000 require full upfront payment.
  5. Water quality as tested is not guaranteed to remain unchanged; regular testing is required.
  6. Customer must ensure permission to utilize water has been obtained.
  7. If the project is halted by the client, a R20,000 (excl. VAT) daily downtime fee applies.
  8. Rubble removal will be as per the quotation.
  9. Contractor is not liable for damage to property during installation caused by the Customer or third parties. Public liability insurance is held.
  10. Contractor is not liable for injury, death, or loss caused during installation, due to the Customer or third parties.
  11. Borehole failures due to geological movement or lack of water rendering the treatment plant unusable is not the Contractor’s liability.
  12. Ownership of the plant and equipment remains with iWater Management until fully paid. Risk passes on delivery.
  13. Both parties consent to Magisterial Jurisdiction.
  14. Customer grants permission for use of project visuals/logos for marketing. iWater Management is released from all related liability under the POPI Act.
  15. These T&Cs apply to all quote phases and form part of the contract.
  16. Warranties – Only manufacturer warranties are enforced. Labour is not automatically included.

Solar Systems

17.1. A valid electrical certificate of compliance is required before installation.
17.2. Additional compliance work on the existing installation is at the Customer’s cost.

Supporting Structures

17.2.1. Customer warrants structural sufficiency.
17.2.2. iWater does not design roofs or slabs and does not assume responsibility for their integrity.
17.2.3. Customer indemnifies iWater against structural failures.
17.2.4. iWater may advise on structural suitability, but not with design responsibility.

17.3. Customer must keep all solar-related equipment clean, dry, and dust-free.
18. Commissioning occurs on or before handover.
19. Customer must include installed equipment in insurance policies from date of delivery.
20. Risk passes on delivery.
21. Ownership remains with iWater Management until full payment is received.

Warranty Provisions

22.1. iWater offers a 2-year installation warranty.
22.2. Reinstallation of supplier-replaced goods is free for 2 years from commissioning.
22.3. Customer bears costs of consumables during replacement.
22.4. Supplier warranties are passed directly to the Customer.

No Warranty – Goods

23.1. iWater is not liable for manufacturer specifications.
23.2. iWater is not the manufacturer and disclaims all implied warranties.
23.3. On delivery and commissioning, goods will be free from material defects.
23.4. Warranties exclude:

  • Non-supplied equipment/materials

  • Damage from wind >40km/h or submersion

  • Acts of God

  • Power surges, fires, floods, etc.These warranty terms apply to new/replacement goods.

  1. Warranty is void if third parties (other than iWater) work on the system.

  2. Warranty is void if third parties (other than iWater) work on the system.


Note: This contract/quote and any following invoices are fully accepted once signed or a deposit is paid.
